I have so many thoughts on the fan art/fiction angle that I think deserve their own blog post....

I've used ChatGPT extensively to brainstorm ideas for Pokémon fanfiction and my TTRPG campaign, and I'm grateful that it doesn't try to filter these outputs. This is an example of where fair use and context matter: fan works (like the Pikachu/Snoopy comic above) can be transformative, and non-commerciality weighs in favor of fair use. It is not ChatGPT's place to second-guess the user's intent and impose guardrails that would be inappropriate for a non-commercial context.

And I've actually been quite careful to use uncopyrightable ideas from the Pokémon franchise, mostly by developing original characters that *happen to be* Pokémon rather than reusing individual characters from the games and anime. In this context, filtering based on named entity recognition would likely lead to a lot of false positives because Pokémon names like "Pikachu" and "Bulbasaur" can refer to either uncopyrightable species concepts or specific, copyrightable characters.
